ARCHITECTURAL PROFESSION ACT 2000 – HOW DO WE UNDERSTAND THE PURPOSE, AIMS AND JUSTIFICATION OF ACT 44 WITHOUT A PREAMBLE

Content/Overview
The policy document on the statutory regulation of the Built Environment Professions (1999) gives the background for the regulation of all Built Environment Professions. In so doing it delineates the intent of Act 44/2000 which is to ensure that the professions fulfil their essential role in the interest of the public.
The purpose of the Regulation of the Professionals are;
a. To protect the public,
b. Recognise Competency Levels,
c. Create acceptable education standards,
d. Create acceptable standards of Practice and
e. Professional Conduct.
The policy document on the statutory regulation of the Built Environment Professions (1999) justifies not only the existence of the Act but also its relation to the professional. The policy states that the “professional expertise in the country is a national asset and should be managed as a scarce resource of high value. This expertise is a resource that is renewable but that is also subject to degradation if standards are allowed to decline and/or interest in entering the professions as a career is not promoted.”
The policy does not only justify the need for professional expertise in South Africa, but states that it is of intrinsic value due to its essential role and function in socio-economic development. And because socio-economic development and the improvement of the quality of life in South Africa requires priority attention, professional expertise needs to be nurtured, professional standards need to be maintained and professional services need to be within reach of all communities.
Therefore, it is only in understanding the intent of Act 44/2000 that we can legitimize the role of a statutory council and Voluntary Associations, the regulation of the architectural profession and the significance of discussions such as this one.
